Terms of Service

These Terms of Service are a legally enforceable contract between you (as much as doing so yourself, or as part of a group or a company) and PEGASO located on the one hand (herein referred to as Company, or we, us, or our). They include the way you will utilise our industrial manufacturing services, receive products, and access our web site. When you place an order with us to get generators, power equipment, or even to join in on our OEM/ODM services you are making an agreement that you have read, comprehended, and will adhere to all this.

2.1 Order Confirmation

However, there is no kick in of a contract unless we are sending out a written Proforma Invoice (PI) or Order Confirmation. When we discuss over coffee that is not binding until we put that in print.

2.2 OEM/ODM Specifications

To make a custom order ( consider a private label, modification on voltage/frequency, or peculiar chassis design ), we required fully detailed and specifications. We cannot solve issues that engage in sketchy drawings, or erroneous information you transmit.

2.3 Lead Time

Mass-production is around 15-30 days on average. We do provide a 15 days expedited delivery on certain models provided we can do so.

• Currency & Taxes We will use the US Dollars (USD) unless indicated otherwise. Prices do not include import duties, VAT and local taxes except DDP shipment.
• Standard Terms You will only pay 30% advance with the rest (70) prior to delivery (when we receive your copy of the Bill of Lading).
• Credit Terms You happen to be a long-term business partner (more than 1000K USD annual volume), then you may receive even less stringent payment terms (such as Net 30 or Net 90), subject to credit approval.

4.1 Incoterms: We go by Incoterms 2020 (FOB, CIF, DDP, etc.), and we will write the very term in your Proforma Invoice.

4.2 Force Majeure: Delay and other losses due to things outside our control- acts of God, war, strike, hiccups in supply chain, or shipping carrier delay- we PEGASO are not responsible.

Exclusions: The warranty will not apply to damage caused by inappropriate installation, abuse, neglect (e.g. not changing oil philtres) or the wear of consumables (philtres, spark plugs, batteries).

6.1 ODM Designs: Any IP, which we develop in the course of creating ODM products, remains ours unless we engage in a special IP transfer contract.

6.2 Buyer Trademarks: You grant us a non-exclusive right to apply your trademarks and logos to your own-label products, only to turn them in to order.

Indirect and incidental and special and consequential and punitive damages, such as having our products associated with lost profits or loss of data, are out of pockets on us, to the limit of the law. In any situation, we cannot have a greater amount of liability than the purchase value of the product which resulted in the problem.
